A Resolution Amending the Sedgwick County Code Provisions for Retail Cereal Malt Beverage Establishments (all districts).

Recommended Action: Approve the resolution.

 

In 2017, the Kansas Legislature approved House Sub. for SB 13, which amended the Kansas Cereal Malt Beverage Act to where retailers licensed by counties pursuant to the Cereal Malt Beverage Act would be able to sell beer containing not more than 6% alcohol by volume.

 

The proposed resolution would utilize the term “enhanced cereal malt beverage” to encapsulate both: (a) traditional cereal malt beverage (beer 3.2% or less alcohol by weight); and (b) beer (not more than 6% alcohol by volume) that cereal malt beverage licensees will be authorized to sell beginning on April 1, 2019. Like the changes in state law, the resolution is proposed to become effective on April 1, 2019.

 

Other changes proposed in the resolution are minor and intended to either improve the operation of this article of the Sedgwick County Code or to bring it into line with other minor changes in state law that have occurred since this portion of the code was last updated.

 

Alternatives: Not to approve the resolution or to approve an amended version of the resolution.

 

Financial Considerations: N/A

 

Legal Considerations: This action is authorized pursuant to K.S.A. 19-101, et seq., and the Kansas Cereal Malt Beverage Act (K.S.A. 41-2701, et seq.). The changes in state law become effective April 1, 2019 and it would be appropriate for the County to adopt changes that make the Sedgwick County Code consistent with state law. Approval of the resolution is by simple majority vote.
