Joint Ordinance and Resolution with the City of Wichita to Approve the First Amendment to Interlocal Agreement.

Body
In 2016, Sedgwick County and the City of Wichita entered into an interlocal agreement for the Metropolitan Area Planning Department ("MAPD") and the Metropolitan Area Planning Commission ("MAPC"). The proposed amendment, which would be entered into pursuant to the proposed joint ordinance and resolution, would clarify language regarding County appointments to the MAPC. In all other respects, the agreement between Sedgwick County and the City of Wichita would remain the same as the 2016 interlocal agreement.

Alternatives:
(1) Elect not to approve the joint ordinance and resolution and the proposed amendment to the interlocal agreement; or

(2) Elect to approve modified version(s) of the joint ordinance and resolution and the proposed amendment to the interlocal agreement.

Financial Considerations: N/A

Legal Considerations: Pursuant to K.S.A. 12-744(c), any agreement or amendment to any such agreement between municipalities for joint planning and zoning services is to be undertaken through an interlocal agreement. Such interlocal agreements are governed by 12-2901, et seq. Pursuant to K.S.A. 12-2904(b), interlocal agreements entered into by counties require approval of a resolution to undertake the action and this requirement is met by the proposed joint ordinance and resolution. After approval of the joint ordinance and resolution and approval of the amendment to the interlocal agreement by the Board of County Commissioners and the City Council for the City of Wichita, the amendment to the interlocal agreement will require approval by the Kansas Attorney General. The proposed amendment to the interlocal agreement is authorized within Paragraph 20 of the interlocal agreement that was approved in 2016.
