Initiate Proposed Amendments to the Sedgwick County Water Well Code for Kansas Department of Health and Environment (KDHE) Consideration.

Recommended Action: Authorize the Chairman to sign the Documentation of Concurrence for County Sanitary Code Review form and authorize County staff to submit the proposed amendments to the Sedgwick County Water Well Codes to the Kansas Department of Health and Environment.

 

Sedgwick County established the current “Domestic Water Well Code” in November 2005, which enacted local regulation to protect public health and water resources of Sedgwick County. Since that time, no amendments or changes have been made to the regulation. The proposed changes were first initiated in 2016. These are mostly administrative in nature, serving to align the code with current policies and Metropolitan Area Building and Construction Department (MABCD) management/administration of management and enforcement activities. Some changes serve to maximize options provided to property owners within safe and sanitary standards. KDHE has accomplished an initial review of the proposed changes. Revisions based on those comments are included in this draft.

Alternatives: The Board of County Commissioners could decide to not pursue any changes to these provisions of the Sedgwick County Code. Alternatively, the Board of County Commissioners could modify the proposed draft of changes before sending it to the KDHE.

 

Financial Considerations: N/A

 

Legal Considerations: Pursuant to K.S.A.19-3704 and K.S.A.19-3705, any county that proposes to change or amend its sanitary code must first submit the proposed changes to the Kansas Department of Health and Environment (KDHE) for their review and approval. Approval is by simple majority vote.
