Agreement with the City of Wichita, Minneha Township, and the Crestview Country Club Improvement District for the Repair and Maintenance of 127th St. East between Central and 13th St. North.  (District 1) (CIP Number R-352).

Recommended Action: Approve the agreement and authorize the Chairman to sign.

 

In 2018, the County Clerk’s Office found an overlap in the boundaries of the City of Wichita and the Crestview Country Club Improvement District. In this case, the overlap does not create any taxation issues because the overlapping area is all in exempt public right of way. The overlap does create jurisdictional issues about road maintenance. The four parties have discussed a number of options to clean up the overlap and jurisdictional issues. The parties have agreed to leave the overlap in place and leave the road with the City of Wichita. Sedgwick County, Minneha Township and the City of Wichita will equally share in the cost of major repairs to the road in 2019. Each will pay $150,000 towards the work which will be managed by Wichita. The Crestview County Club Improvement District consents to the continued existence of the overlap.

 

Alternatives: Take such action as the Board deems appropriate.

 

Financial Considerations:  The County will contribute up to $150,000 in 2019 to the road repair project; this funding is included in the approved CIP and no additional budget authority is required.

 

Legal Considerations: The BOCC is authorized to make all contracts in relation to the property and concerns of the county under K.S.A. 19-101 fourth; and to perform such duties as required by law concerning roads under K.S.A. 19-212 Ninth. Under K.S.A. 12-2908, the BOCC may enter into contracts with other cities or townships to perform any governmental service, activity or undertaking that each entity is authorized to perform.
