Recommended Action: Approve the agreement and authorize the Chairman to sign.

 

OxyChem owns property on all four corners of the intersection of Ridge Road and 63rd Street South. During heavy rainfall events, the roadside drainage system in the area can become overwhelmed from runoff. In events where the runoff overtops the ditch system and enters their plant site, they are required to treat the runoff as if it fell of the plant site and could be contaminated with chemicals.

 

OxyChem has proposed a number of improvements (culverts, flood valves, grates, etc.) that must be constructed in the road right of way in order effectively control excess runoff. Under the terms of the agreement, OxyChem will construct the improvements and Sedgwick County will reimburse the company for half of the construction costs.  Funding for the County portion will come from R-264, Miscellaneous Drainage Projects.

 

OxyChem will take competitive bids for the work and meet with Public Works prior to awarding a contract. They would like to complete the project before the spring rains.

 

Alternatives: Take such action as the Board deems appropriate.

 

Financial Considerations: The estimated project cost is $60,000. Sedgwick County’s estimated share is $30,000. Sufficient budget authority exists in R-264, Miscellaneous Drainage Projects for this agreement.

 

Legal Considerations: The BOCC is authorized to make all contracts in relation to the property and concerns of the county under K.S.A. 19-101 fourth; and to perform such duties as required by law concerning roads under K.S.A. 19-212 Ninth.
