A Resolution amending Chapter 20, Article IV of the Sedgwick County Code relating to Parks, Lakes, and Recreational Facility Rules.

Recommended Action: Approve the Resolution.

 

Chapter 20 of the Sedgwick County Code relating to rules and regulations for the use of Sedgwick County parks, lakes and recreational areas is in need of updating.  The following is a non-exhaustive list of the primary areas the amendment being requested for approval will alter:

                     Addition to the definitions making the rules and regulations as well as the enforcement thereof more clear.

                     Addition of subsection (c)(8) to Section 20-108 Park Superintendent.

                     Recommended fee and deposit increases as approved in the 2019 Budget.

                     Amendments to the rules and regulations in Section 20-113 Camping.

 

Alternatives: Do not approve the amendment.

 

Financial Considerations: 2018 revenues for charges for service at Lake Afton Park and Sedgwick County Park are budgeted to total $228,554 based on current Park fees.  Additional revenues of $23,400 are projected based on the recommended fees in the resolution.

 

Legal Considerations: The county is authorized pursuant to K.S.A. 19-101 et seq. to enact and enforce this resolution; more specifically, K.S.A. 19-2803a allows the county to adopt, by resolution, reasonable rules and regulations regulating and licensing the use and enjoyment of any park, lake or other recreational area by the public and for the protection and preservation of such property. K.S.A. 12-16,124 prohibits a county from adopting or enforcing any ordinance, resolution or regulation governing the carrying of firearms or ammunition.  A majority vote is required.
