Title

Agreement with KDOT for Use of Highway Right of Way and Grant of Permanent Easement and Two (2) related Grant of Permanent Easement Documents.   District 2.

 

Recommended Action: Approve the agreement and both easements and authorize the Chairman to sign.

 

Body

Sedgwick County holds fee title to property that was originally acquired by the Protection Drainage District and is located adjacent to I-235 and west of West Street in south Wichita. Drainage systems on the property are operated and maintained by Flood Control. The Kansas Department of Transportation (KDOT) needs two permanent easements on the property. The easements and planned construction will not interfere with operation of the drainage system.

 

KDOT requests that the Board enter into an agreement to donate the easements and execute the two related easement documents (total of three documents).

 

Alternatives: Take such action as the Board deems appropriate.

 

Financial Considerations: Sedgwick County will agree to donate the two easements to KDOT.

 

Legal Considerations: The BOCC is authorized to purchase and hold real property for use of the county under K.S.A. 19-101 second; and to make all contracts in relation to the property and concerns of the county under K.S.A. 19-101 fourth.
