RESOLUTION REPEALING AND REPLACING SECTION 8.4(b) OF THE SEDGWICK COUNTY CODE.

RECOMMENDED ACTION: Approve the Resolution.

 

Body

Pursuant to K.S.A. 19-101, et seq. and 19-4701, et seq., the Sedgwick County Board of County Commissioners (“County”) has the authority to enact and provide procedures for the enforcement of County resolutions and may exercise the powers of home rule to determine its local affairs and government.  Currently, Chapter 8, section 8.4(b) of the Sedgwick County Code states that “The County may contract with credit card companies to provide for collection of bank card drafts from valid and unexpired credit cards used to pay for any fines or court costs, and any other fee or charge. The County shall pay any transaction fees or costs associated with accepting such bank card drafts.”

 

However, the County has now secured a vendor that will directly pass along those transaction fees to the tax payers and customers and thus, the County will not be charging a fee.  Therefore, section 8.4(b) no longer accurately reflects the current practice.

 

Alternatives: Do not approve the resolution.

 

Financial Considerations: No direct financial impact from this action; the 9/12/18 action taken by the Commission effectively ended any costs assessed to the County and charges assessed to citizens directly by the County.

Policy Considerations: This action is pursuant to the approval of the Board of Bids and Contracts for Merchant Services provided by Gila, LLC dba Municipal Services Bureau (MSB) by the Board of County Commissioners on September 12, 2018.
