Recommended Action: Authorize the repealing and replacing of resolution 209-2017.
On December 20, 2017, the BOCC enacted Resolution No. 209-2017 establishing a daily fee for inmates placed in a work-release program. The request for repeal and replacement is to change reimbursement from a room and board fee formula to a standard daily fee.
Alternatives: Leave the current resolution in place which has a formula for fees rather than a standard daily fee.
Financial Considerations: The Director of Corrections shall adopt a fee schedule establishing the amount of fee payable by participants up to $20.00 per day in proportion to the compensation received by the inmate, and, the Director, upon request, may waive the fee in instances where payment would create undue hardship for an inmate. No additional budget authority is being requested; sufficient budget authority exists in the 2018 and 2019 budgets. Revenue will be deposited in the Work Release Program (33032-110).
Legal Considerations: The Resolution has been "Approved As To Form" by the Assistant County Counselor. The authority for this action is K.S.A. 19-101. A simple majority vote is required.
