Recommended Action: Approve the resolution.
Public Works has acquired all required right-of-way for the project except one parcel. After extended negotiations with the property owners and a professional appraisal staff has been unable to reach an agreement on compensation. Public Works recommends that the Board of County Commissioners make a finding that it is necessary to acquire the needed easements through eminent domain proceedings.
Alternatives: Take such action as the Board deems appropriate.
Financial Considerations: The County will be liable for all costs for court filings, court costs, and compensation to the owners and County’s cost of litigation.
Legal Considerations: K.S.A 68-114 and K.S.A. 25-501, et. seq. authorizes counties to acquire real property through eminent domain when the owners have refused to sell or donate property to the county.
