RECOMMENDED ACTION: Open the public hearing, accept public comments, and close public hearing.  Approve the grant application and related Agreement with the City of Wichita.  Authorize the Chairman or his designee to submit the application through the Justice Department Grants Management System (GMS), execute all grant documents (as required) including a grant award agreement containing substantially the same terms and conditions as the application.  Approve the establishment of budget authority at the time the grant documents are executed.

 

Body

The Edward J. Byrne Memorial Justice Assistance Grant (JAG) Program is the primary provider of federal criminal justice funding to the State and units of local government.  JAG funds support all components of the criminal justice system, from multi-jurisdictional drug and gang task forces, to crime prevention and domestic violence programs, courts, corrections, treatment, and justice information sharing initiatives.  JAG awards are based on a statutory formula that involves computing an allocation for each state and territory, based on their share of violent crimes and population (weighted equally) with each state's share being a minimum of 0.25% of the total appropriation.  Each state's final award amount is then divided between the State and local governments at a rate of 60 and 40 percent respectively. The local governments share is allocated to the individual governments based on their share on the state's 3-year violent crime average with a minimum allocation of $10,000. All allocations under $10,000 are returned to the state to be awarded through a separate application process. 

 

 BJA estimates that it will make up to 1,147 local awards totaling $84,500,000.

 

JAG funds can be used for State and local initiatives, technical assistance, training, personnel, equipment, supplies, contractual support, and information systems for criminal justice for one or more of the following categories:

     - Law enforcement programs;

     - Prosecution and court programs;

     - Prevention and education programs;

     - Corrections and community corrections programs;

     - Drug treatment and enforcement programs;

     - Planning, evaluation, and technology improvement programs; and

     - Crime victim and witness programs (other than compensation)

     - Mental Health programs and related law enforcement and corrections programs, including behavioral programs and crisis intervention teams.

 

This year, Sedgwick County and the City of Wichita were allocated $375,695.00 in JAG grant funds.  Funds will be distributed evenly between the two jurisdictions via an Agreement. Sedgwick County's share of the award, $187,847.50, is available to all departments within the Department of Public Safety, in addition to the Division of Information, Technology & Support Services, Sheriff's Office, District Attorney's Office, Courthouse Police, and District Court. Divisions submitted their requests for funding to an internal advisory committee. Requests were received from the District Attorney, Regional Forensic Science Center, Corrections, Courthouse Police, and the Sheriff.  The JAG Advisory Committee made its decisions based on priority need and eligibility under the JAG requirements.

Grant Summary and Timeline: The JAG Grant solicitation was posted on the Bureau of Justice Assistance (BJA) website on July 23, 2018 and notification was sent out at that time to all eligible jurisdictions.  All registrations and applications are due in OJP Grants Management System (GMS) by 5:00 p.m. eastern time on August 22, 2018.

Budget Authority Adjustment: $150,000.00 in new internal orders/fund centers for 2018; budget authority for the residual balances of the projects may be established in 2019 and beyond, since the grant periods ends in 2021.

 

Personnel considerations: None.

 

Expected measurable outcomes: The JAG Grant represents funding for five divisions to replace outdated equipment, provide crucial services for crimes to be adjudicated and to increase operational efficiency and effectiveness for individual division and offices that will lead to an increase in law enforcement effectiveness. The benchmarks for these purchases and expenses will vary between each division and are reported to the Justice Department quarterly through their Performance Measurement Tools (PMT) website. Additional details on measurable outcomes for each project are included in the JAG 2018 Project Submissions forms included in the attachment section of this Legistar Item.

 

Requirements from Sedgwick County: Sedgwick County must comply with the standard federal grant assurances and certifications as well as JAG Grant requirements specified in the JAG '18 Local Solicitation document which is included in the attachment section of this Legistar Item. Additionally, the County must submit quarterly; reports of expenditures in the GPRS website and reports of grant activity in the PMT website.

Legal considerations: This action is authorized pursuant to K.S.A. 19-101. 42 U.S.C. 3750-3758 permits such grants. A simple majority vote is required.
