Resolution to Amend Section 20-2 of the Sedgwick County Code to Prohibit the Use of Electronic Cigarettes in County Buildings.

Recommended Action: Approve the Resolution.

 

Background:

The language that is presently included within Section 20-2 of the Sedgwick County Code prohibits the usage of cigarettes in County-owned, County-occupied, and leased buildings. The present language of Section 20-2 also treats the usage of electronic cigarettes differently than cigarettes, which means that the usage of electronic cigarettes is not prohibited.

 

The proposed resolution would amend Section 20-2 so that the usage of cigarettes and electronic cigarettes would be prohibited in County-owned, County-occupied, and leased buildings. The proposed resolution would also require that a verbal warning be issued to any person prior to that person receiving a citation for smoking or using an electronic cigarette in County-owned, County-occupied, and leased buildings.

 

Alternatives:                     (1) Not to approve the resolution.

(2) Approve a modified version of the resolution.

 

Financial Considerations: N/A

 

Legal Considerations: The Board of County Commissioners can amend the Sedgwick County Code pursuant to K.S.A. 19-101, et seq. Enforcement of the Sedgwick County Code is pursuant to K.S.A. 19-4701, et seq. and provisions the Board of County Commissioners has approved that are included within the Sedgwick County Code.  Approval of the resolution is by simple majority vote.

 

Policy Considerations:  The policy considerations discussed by the Board of County Commissioners during its June 13, 2018 meeting on the personnel policy related to the usage of electronic cigarettes are very similar to the policy considerations in this matter.
