Recommended Action: Approve the agreement and authorize the Chairman to sign.
Every other year the County takes over five miles of township roads and reconstructs them with cold mix asphalt or super seal type pavement as part of R342. For 2018, property owners adjacent to 37th St. N. (David and Tammy Doyel) approached Commissioner Unruh and offered to pay for 25% of the cost to pave 37th St. from 127th St. E. to 143rd St. E. in order to incentivize the County to include that mile in the 2018 project. The agreement lays out the specific arrangements for construction and financing of the 37th St. N. portion of the project.
Alternatives: Decline the Doyels' contribution to the project.
Financial Considerations: The Doyels have agreed to pay for 25%, up to $100,000.00, of the cost to construct 37th St. N. within 30 days after project completion and billing. Based on the bids received, their share is expected to be less than $50,000.00.
Legal Considerations: The BOCC is authorized to make all contracts in relation to the property and concerns of the county under K.S.A. 19-101 fourth; and to perform such duties as required by law concerning roads under K.S.A. 19-212 Ninth.
