Recommended Action: Approve the resolution and authorize the Chairman to sign.
The Sedgwick County Zoological Society Inc. (Society) currently holds a cereal malt beverage license issued by the Board of County Commissioners (BOCC) which expires on December 31, 2018. The Society is requesting and does hereby consent to and support the voluntary suspension of its license for certain dates due to special events scheduled for 2018.
Financial Considerations: None.
Legal Considerations: K.S.A. 2017 Supp. 41-2704(g) and K.S.A. 2017 Supp. 41-2708(a)(5) prohibit alcoholic liquor from being on a premises licensed for cereal malt beverage sales. K.S.A. 201 Supp. 41-2703 places responsibility for licensing the retail sale of cereal malt beverages upon counties. In order to comply with statutes, limited suspension of the cereal malt beverage license is necessary and the County has the power to do so under K.S.A. 2017 Supp. 41-2703. A simple majority vote is required.
