Financial Considerations: Costs associated with the recommended agreement are budgeted in the County's 2018 Adopted Budget and will be reimbursed by the State of Kansas, per the agreement, into cost center 22001-207, Noxious Weeds. The agreement is a significant revenue source for the Noxious Weeds Department and accounts for around $25,000 of non-tax revenue annually.
Legal Considerations: The BoCC is authorized to make all contracts in relation to the concerns of the County under K.S.A. 19-101 fourth. The Secretary of the Kansas Department of Transportation and the County Commission have a duty to control the spread of noxious weeds under K.S.A. 2-1314. This contract is similar in terms and conditions to prior contracts approved by the BoCC for this purpose. Approval is by simple majority vote.
