Approval of an agreement between the Kansas & Oklahoma Railroad Company, Sedgwick County and the Secretary of Transportation of the State of Kansas regarding the installation of railway-highway crossing signals, flashing light straight post type and gates at the intersection of Hoover and the K&O tracks north of Sedgwick County Park. District 3.

Recommended Action: Approve the agreement and authorize the Chairman to sign.
Alternatives: Take such action as the Board deems appropriate.
Financial Considerations: 100% Federally Funded. Per the agreement, Kansas & Oklahoma Railroad Company will be reimbursed for the full cost of crossing improvements by the State of Kansas using Federal funds. Costs incurred by the County from installing the warning signs will be operational costs funded out of the existing operational budget.
Legal Considerations: 23 U.S.C. §130 provides for federal funding of these improvements. The BoCC is authorized to make all contracts in relation to the property and concerns of the County under K.S.A. 19-101 fourth; and to perform such duties as required by law concerning roads under K.S.A. 19-212 Ninth. This contract is similar in terms and conditions to prior contracts approved by the BoCC for this purpose. Approval is by simple majority vote.
