Recommended Action: Approval and authorize the appointment of Special Counsel.

 

K.S.A. 22a-106 (d) provides, in relevant part, “…the district attorney, with the approval of the board of county commissioners, may appoint and employ special counsel when necessary to assist the district attorney in the discharge of his duties…” The District Attorney is requesting approval of his appointment of Angela Wilson as special counsel pursuant to this law.  Ms. Wilson is currently an assistant district attorney who will be leaving full-time employment in this jurisdiction to pursue a part-time prosecutorial position in another jurisdiction.  As an assistant district attorney, Ms. Wilson has been involved in a complex project in a specialized area of the law for over a year. It is anticipated the project can be completed within the year if Ms. Wilson is able to continue work on it as special counsel on a part-time basis. Otherwise, new and increased resources would need to be brought to bear to bring the project to an end, at greater cost and with lengthier proceedings.

 

Alternatives: N/A

 

Financial Considerations: The total estimated costs for this position is not to exceed $5,000 and the District Attorney's general fund budget has sufficient funding to meet the financial obligation.

 

Legal Considerations: K.S.A. 22a-106(d) provides authority for this action.  A simple majority vote is required.
