Dedication of a Utility Easement to the City of Wichita at Intrust Bank Arena.

Recommended Action: Approve dedication of the utility easement and authorize the Chairman to sign.
Mobilitie, a provider of small cell towers, has requested an easement across a portion of the Intrust Bank Arena property to provide access to a Westar transformer so that power can be extended to a proposed tower site on St. Francis north of the Arena. The transformer is located approximately 30 feet west of St. Francis Street and 3 feet south of the north line of the arena property. No easement currently exists to connect the transformer to St. Francis Street. Public Works recommends that the County provide a 10' X 35' public utility easement to the City of Wichita. Once approved, Mobilitie will be able to use the easement to access the transformer with their service line. If there is a need to extend power out of this transformer to other providers in the future, they will also be able to use this easement.
Alternatives: Decline to provide the utility easement or direct staff to use some other type of easement.
Financial Considerations: There is no cost to the County.
Legal Considerations: The BoCC is authorized to purchase and hold real property for use of the county under K.S.A. 19-101 second; and to make all contracts in relation to the property and concerns of the county under K.S.A. 19-101 fourth. Approval is by simple majority vote.
