Resolution Notifying the City of Haysville of a Segment of 71st Street South (Grand Avenue) Which Has Not Become Part of the City by Annexation.

Recommended Action:  Adopt the resolution and authorize the Director of Public Works to send the resolution to the City of Haysville.

 

K.S.A. 2015 Supp. 12-520(e) provides that the Board of County Commissioners (BoCC) may notify a city of the existence of a highway which has not become a part of the city by annexation, and which has a common boundary with the city. This resolution is a request that the City of Haysville (City) annex the south half of 71st Street South from a point a quarter mile west of Meridian Avenue to a point a half mile west of Meridian Avenue so that all of 71st Street South would be within the City’s limits. Accordingly, the City would be responsible for all future maintenance pertaining to the portion of 71st Street South that is annexed.

 

Per statute, the notification from the BoCC is required to include a legal description of the highway and a map with the resolution. Upon the City’s receipt of the resolution, the City would certify by ordinance that the factual claims in the County’s resolution are accurate and the City would then annex the described portion of Meridian Avenue.

 

Alternatives:  To not approve the resolution so that the road remains under Sedgwick County control and maintenance.

Legal Considerations:  This action is authorized by K.S.A. 2015 Supp. 12-520(e).  Approval is by simple majority vote.
