Recommended Action: Approve the encroachment agreement and authorize the Chairman to sign.
Southern Star Central Gas Pipeline has pipeline within an easement running along 47th St. South. The private easement lies under and pre-dates the County's right of way. Construction within the private easement must meet South Star's standard and can only proceed with their consent. The agreement lays out specific design construction requirements for the area of the encroachment.

Financial Considerations: There is no cost for the encroachment agreement. Certain construction requirements will have to be met.
Legal Considerations: The BoCC is authorized to make all contracts in relation to the property and concerns of the county under K.S.A. 19-101 fourth; and to perform such duties as required by law concerning roads under K.S.A. 19-212 Ninth. This contract is similar in terms and conditions to prior contracts approved by the BoCC for this purpose.
