Recommended Action: Approve the amendment and authorize the Chairman to sign.

The Sedgwick County Developmental Disability Organization (SCDDO) was notified by In Sync Home Health, Inc. that they will be going out of business and cannot renew their developmental disability affiliation agreement for fiscal year 2018. Affiliation agreements serve to subcontract the provision of intellectual and developmental disability (IDD) Medicaid Waiver services as required by the State of Kansas. The second amendment extends the term of the fiscal year 2017 affiliation agreement through November 30, 2017, to allow individuals receiving services from In Sync sufficient time to select another provider and to get services in place without a gap.

Alternatives: Without this amendment the affiliation agreement, which is required to be in place for services to be paid for by Medicaid, would have expired August 31st and the individuals served by In Sync might have experienced a gap in services.

Financial Considerations: Funding for services provided pursuant to this amendment is through Medicaid; this amendment does not involve any SCDDO funding. The State of Kansas requires affiliation agreements be in place for agencies to bill Home and Community Based Services for individuals on the IDD Medicaid waiver.

Legal Considerations: The authority for this action is K.S.A. 39-1805. This amendment requires BoCC approval under Charter Resolution No. 68. A simple majority is required.

Policy Considerations: The SCDDO is required to contract with qualified service providers that have been selected by an individual who is eligible to receive IDD services.
