CANCELLATION OF KANSAS DEPARTMENT OF CORRECTIONS (KDOC) PROVIDER CONTRACT FOR THE SEDGWICK COUNTY YOUTH PROGRAM (SCYP).

RECOMMENDED ACTION: Approve the contract cancellation and authorize the chairman to sign the 30 day written notice to KDOC.

The Sedgwick County Youth Program (SCYP) is licensed as a Youth Residential Center II (YRC II). SCYP serves male juvenile offenders ages 16 1/2 to 22 who are leaving state-operated juvenile correctional facilities. The purpose of the program is to assist juveniles in preparing for independent living. On August 24, 2017 the Kansas Department of Corrections announced new eligibility requirements for YRC II facilities. SCYP does not meet the new YRC II licensing requirements that go into effect on January 1, 2018.
Alternatives: Sedgwick County can let the contract expire on 12/31/17 rather than terminate the contract early. SCYP is not accepting new referrals and has one youth left in the program at this time. Sedgwick County can choose to participate in a Request for Proposal (RFP) process administered by KDOC. The RFP is for 20 residential beds (10 male and 10 female) for youth under the age of 16 1/2.
Financial Considerations: KDOC reimburses Sedgwick County at $126.00 per day for youth placed at SCYP. This revenue stream will cease upon program closure. 2016: Expenses = $711,999 and Revenue = $605,175. 2017 YTD: Expenses = $468,608 and YTD Revenue = $412,394.
Legal Considerations: The authority for this action is K.S.A. 19-101 and K.S.A. 75-7292 et.seq. A simple majority vote is required. Section XII of the current provider agreement states: "The parties mutually agree that either KDOC or vendor may terminate this contract at any time, without cause, by giving written notice to the other party at least thirty (30) days prior to the selected termination date.
