Resolution for Interlocal Agreement with Butler County for Radio Tower.

Recommended Action: Approve the Resolution.
On April 19, 2017, the Board of County Commissioners adopted an interlocal agreement (attached) with Butler County for a cooperative effort to maintain/sublease a radio commucations tower in Butler County. This was agenda item #17-358. The agreement refers to a resolution (top of page 2), but that resolution was inadvertently left off the agenda item when it was presented to the Commissioners. Therefore, the Commissioners are asked to approve this Resolution to complete the agreement.

Legal Considerations: This action is required to implement the provisions of the interlocal agreement which by its own terms required a resolution to make the agreement effective. Both entities are public agencies, as that term is defined in K.S.A. 12-2903, and are capable of entering into an Interlocal Agreement pursuant to K.S.A. 12-2904. The authority for this action is K.S.A. 19-101, fourth, under which Sedgwick County can make all contracts and do all other acts in relation to the concerns of the County. Approval is by simple majority vote.
