Some of Rockford Township’s (“Township”) unpaved roads are presently in poor condition and the Township lacks the resources to immediately repair or maintain these roads.

This matter was discussed as a potential services agreement during the meeting on September 16, 2017, when County staff was asked to bring this matter forward as a memorandum of understanding (“MOU”). K.S.A. 68-572 contemplates that counties and townships may enter into agreements for the construction, reconstruction, or maintenance of roads or streets. The MOU would essentially establish a framework under which the Township board could identify specific road(s) maintenance, construction, and/or reconstruction services. This would be conveyed to Sedgwick County as a request for quote (“RFQ”). The County could then provide a quote for the requested work so that it could be considered by the Township board in the form of a draft agreement. Any final approval on an agreement would be by the Board of County Commissioners.

In order to enter into any such agreements, the Township would have to have sufficient funding on-hand at the time the funds would become due.

The Township board has approved this MOU.

Alternatives: (1) Enter into the MOU; or (2) not enter into the MOU.

Financial Considerations: N/A. Any financial impact would stem from potential subsequent agreements entered into as a result of the framework proposed in this agreement.

Legal Considerations: Sedgwick County and the Township can enter into an agreement for services pursuant to K.S.A. 12-2908. Furthermore, K.S.A. 68-572 contemplates that ...
