On April 12, 2017, the Board of County Commissioners increased the minimum square footage that would trigger a building permit for accessory structures from 200 square feet to 400 square feet. During that same item, the Board of County Commissioners did not approve proposed language to add the requirement for location permits on buildings less than 400 square feet that would not otherwise have a building permit. Instead, the Board of County Commissioners asked for the location permit item to be brought up as a separate item.

The addition of a location permit was proposed to address situations in which a property owner might otherwise build a structure: (1) within a floodplain (and avoid potential situations where the County would later be required to take all action to have the structure removed or modified to be compliant with the floodplain); (2) in an easement; or (3) into setbacks.

The draft resolution would have the location permit include an informal site plan that could be submitted to MABCD staff for their review. The location permit would be free. Based upon the site plan, MABCD staff would then determine whether the proposed location of the building would be sufficient and no follow-up inspection would be completed.

This item was presented to the Board of Building Code Standards and Appeals (“Building Board”). The Building Board took no action on the item.

Alternatives: (1) Adopt the resolution; (2) vote not to adopt the resolution; or (3) adopt a modified version of the resolution.

Legal Considerations: Authority is contained within K.S.A. 19-101 et seq. Approval is by simple majority vote.

Anybody could submit a false site plan and the County would never be the wiser. Another burden placed on property owners that will have NO benefit but helps keep the bureaucracy employed.
