A RESOLUTION WAIVING APPLICATION OF THE SEDGWICK COUNTY SERVICE DRIVE CODE AS IT PERTAINS TO CERTAIN PROPERTY LOCATED IN SEDGWICK COUNTY, KANSAS.

RECOMMENDED ACTION: Approve the Resolution.
Body
The purpose of the resolution is to waive the requirements of the Sedgwick County Service drive code (Sedgwick County Code section 12-201 et. seq.). The property off of 143rd East was granted by Metropolitan Planning Subdivision, to allow a fourth property on a service or private drive without having to bring the private drive up to rural road standards. The property owners have now requested to be allowed to waive the requirements for application of the Service Drive Code due to placing a financial hardship on the property owners. This is due to the current drive going across a pond dam and through a flood plain. These properties are land-locked on three sides by flood plain and access from the south is restricted by Kansas Department of Transportation (KDOT).

Legal Considerations: This action is authorized by K.S.A. 19-101. A simple majority vote is required. In exchange for enacting the resolution, the property owners will waive claims against the County and the Fire District in accordance with the Waiver of Claims attached to the resolution. The resolution, if passed, will become effective upon agreement of all property owners.
