Government Services Agreement for Sanitary Sewer and Water Well Code Inspection and Enforcement Services with the Cities of Garden Plain, Clearwater, Kechi, and Park City.

Recommended Action: Approve the agreements and authorize the Chairman to sign.

 

The cities of Clearwater, Kechi, and Park City wish to have Sedgwick County perform sanitary sewer and water well code inspection and enforcement services within their city limits.  The City of Garden Plain is specifically requesting solely water well code inspection and enforcement services.

 

In order to ensure proper jurisdiction and enforceability, and also to ensure that the cities’ home rule powers are not impinged upon, the proposed agreements for the aforementioned services would be reached between the Board of County Commissioners and the cities’ governing bodies.  As part of this process, the cities have agreed to adopt the County’s sanitary sewer and water well codes within their city limits.  Furthermore, the cities agree to grant the County jurisdiction to prosecute any violations of those codes in County Court.

 

Metropolitan Area Building and Construction Division (“MABCD”) staff would undertake all of the work on such inspections and the County would receive all fees associated with such inspections.

 

Alternatives:  Not to approve the agreements.

 

Financial Considerations:  n/a

 

Legal Considerations:  The County can enter into these agreements pursuant to K.S.A. 12-2908.  Approval is by simple majority vote.
