Order for Road Vacation Matter on 71st Street South near 143rd Street East.

Recommended Action: Approve the order and direct the County Counselor’s Office to record it with the Sedgwick County Register of Deeds.
On May 3, 2017, pursuant to Charter Resolution No. 64, the Board of County Commissioners held a hearing regarding a road vacation of a portion of 71st Street South to the west of 143rd Street East. The Board of County Commissioners made the following findings to support the vacation:
(1) That all required notices were provided;
(2) That the road does not provide any public utility due to nonuse, inconvenience, and the prior re-routing and vacation of 71st Street South to the west of this location;
(3) Any present or future public utility does not justify the expenditure of necessary funds to continue to repair the road and keep it in condition for public travel;
(4) The public will not suffer any unreasonable loss or inconvenience and no private rights will be endangered or injured; and
(5) That it would be appropriate for the right-of-way to be vacated so the property owners could use the vacated property for purposes other than road right-of-way.
Such findings are reflected in the proposed order.

Legal Considerations: Charter Resolution No. 64 is the authority for the proposed action. Its terms require the County Counselor’s Office to prepare an order consistent with the findings and also to record said order with the Register of Deeds. Approval is by simple majority vote.
