Adoption of a Resolution and approving the contract between KDHE and Sedgwick County for corrective action at an illegal dump site.

RECOMMENDED ACTION: Approve the Contract and Resolution.
Background: In order to protect the health, safety and welfare of an area, KDHE locates properties that were utlitilized for the illegal disposal of solid waste. Such a property has been found in Sedgwick County, near the City of Andale. KDHE has requested Sedgwick County to partner with the State to address the cleanup of this site. Sedgwick County will perform the corrective action at the site. KDHE will reimburse the county for 75% of their actual costs for the corrective action, not to exceed $10,000. Sedgwick County can use in-kind service for the remaining 25% of the county's expenditures.

Financial Considerations: KDHE estimates that this illegal dump cleanup will cost $4,500. The contract is not to exceed $10,000. The county will be reimbursed for 75% of expenses incurred for this project. The remaining 25% can be in-kind services, such as staff time.
Legal Considerations: The authority for this action is K.S.A. 65-3415(a). A simple majority vote is required.
