VAC2016-00062 - County request to vacate a platted utility easement on property located on the southeast corner of South 119th Street West and West 103rd Street South (District 2 - City of Clearwater’s Urban Area of Influence).

Recommended Action: Follow the recommendation of the Metropolitan Area Planning Commission, approve the Vacation Order, and authorize the necessary signatures.

 

Background: The applicant proposes to vacate the 10 foot utility easement located on the south side of Lot 1 and the north side of Lot 2, Willard Parker’s 1st Addition.  There is no public water, sewer, or stormwater equipment in the described easement.  Willard Parker’s 1st Addition was recorded with the Register of Deeds October 2, 1992.

 

Analysis:  The MAPC voted (13-0) to approve the vacation request.  No one spoke in opposition to this request at the MAPC’s advertised public hearing or its Subdivision Committee meeting.  The City of Clearwater’s Planning Commission approved this request at their February 7, 2017 meeting.  No one spoke in opposition to this request at the Clearwater meeting.  No written protests have been filed.

Financial Considerations: Approved by Division of Finance; complies with Kansas Budget Law and Cash Basis Law Not applicable.

 

Legal Considerations: Approved as to form and signed by County Counselor’s Office                    

The Board of County Commissioners is authorized by K.S.A. 58-2613, et seq. to grant petitions for vacation of platted streets, alleys, public easements and public reservations. The order is approved as to form and signed by County Counselor’s Office                     

A certified copy of the Vacation Order will be recorded with the Register of Deeds.
