Agreement with the City of Derby to Perform Construction Engineering Services for a Federally Funded Project on Madison Avenue from Derby High School to High Park in Derby.  District 5.

Recommended Action: Approve the agreement and authorize the Chairman to sign.

 

The City of Derby has been awarded federal funds for the reconstruction of Madison Avenue from Derby High School to High Park (approximately Rock Road to Webb Road) through the Wichita Area Metropolitan Planning Organization (WAMPO).  Federally funded projects are administered through KDOT and construction engineering must be provided by KDOT certified inspectors.  Derby does not have any certified inspectors on staff and has typically contracted with the County to provide these services.  The County does have a number of KDOT certified inspectors on staff in order to perform this type of work on County projects.  The Director of Public Works has determined that County personnel can accommodate the timing and magnitude of the work requested by Derby.  The Derby City Council approved the agreement on January 10, 2017.

 

Alternatives:  Take such action as the Board deems appropriate.

 

Financial Considerations:  The City of Derby will reimburse Sedgwick County for all costs incurred up to $108,894.19. No additional budget authority is being requested.

 

Legal Considerations:  The BoCC is authorized to make all contracts in relation to the property and concerns of the county under K.S.A. 19-101 fourth and to perform such duties as required by law concerning roads under K.S.A. 19-212 ninth.  Under K.S.A. 12-2908 the BoCC may enter into contracts with other cities or townships to perform any governmental service, activity or undertaking that each entity is authorized to perform.
