Body

Flooding from storms on July 3, 2016, and September 9, 2016 has damaged a bridge on 61st St. North between Oliver and Woodlawn.  The bridge consists of a pair of steel plate arch pipes (2 at 12' 7" x 7' 9") that have been in place since 1972.  The initial storm damaged the bottom of one of the pipes by buckling up the bottom of the pipe for approximately 40 feet.  The storm in September eroded supporting soils which resulted in about 10 inches of deformation in the sidewall.  It is not possible to repair the existing pipes.

 

Major storms could erode out enough supporting soil to allow the pipe failure to continue, which would lead to settlement in the road bed.  Public Works has posted the bridge at 3 Tons and implemented a monitoring program to detect settlement in the road.  If settlement is detected or further damage is found after a major rain, the bridge will have to be closed.  The road carries over 3,000 vehicles per day and is the major link between K-254 highway and the cities of Kechi and Park City.

 

Sedgwick County's purchasing policy and the Kansas Statutes provide for emergency repairs of roads and bridges.  Projects would normally be advertised for 30 days and formal bids would be accepted and processed by the Sedgwick County Purchasing Department.  The County Counselor's Office has advised that an agreement can be entered into based on expedited contracting procedures under Sedgwick County Charter Resolution 65, K.S.A. 68-521 and K.S.A. 68-1413 if certain conditions are met.  These conditions are:

 

                     1.  The road has been damaged as a result of a disaster.  (Engineering reports have tied the damage to a disaster.)

                     2.  The Governor has declared the County has a disaster area.  (Declaration was issued on September 23, 2016.)

                     3.  A hardship will result if the road is not immediately repaired.  (Finding to be made by the Board.)

                     4.  The Board received an engineer's estimate for the project from the County Engineer.  (Estimate attached in the backup material.)

                     5.  Contract must be awarded within 60 days of the Governor's disaster declaration.  (Last day to act is November 22, 2016.)

                     6.  The Purchasing Director finds that an emergency exists.  (Competitive bidding requirements waived by the Purchasing Director on                      November 9, 2016.)

 

Public Works recommends that the Board make findings that all of the required conditions have been met. 

 

Public Works staff has designed a replacement structure.  In order to expedite the replacement process, precast concrete box culverts have been ordered from Wichita Concrete Pipe based on regular contract pricing at a cost of approximately $48,000.  Plans have been prepared that would have a contractor use the pre-purchased material to construct the new bridge. Time savings will be achieved with this two-part purchase because it has allowed the fabrication of critical material to proceed while design and contractor selection occurs.

 

Public Works, in cooperation with the Purchasing Department, has solicited bids from a number of qualified contractors.  Invitations were sent to contractors on Thursday, November 10, 2016, that invited them to a non-mandatory pre-bid conference on November 15th.  Final plans were provided to the contractors on November 16th that addressed comments or concerns of attendees at the pre-bid conference.   Interested contractors were required to submit bids by email to Public Works and Purchasing no later than 5:00 pm on November 18, 2016.  Public Works has tabulated the bids and prepared a recommendation for consideration by the Board of County Commissioners.

 

The bid tabulation and the name of the recommended contractor will be provided at the time of the Board meeting by the County Engineer.

 

Alternatives:  Take such action as the Board deems appropriate.

 

Financial Considerations:  Prior to award of a contract, the Board will need to approve a CIP Amendment to create budget authority for the construction portion of the project. (Agenda Item #16-771)

 

Legal Considerations:  The Board of County Commissioners is authorized to make all contracts and do all other acts in relation to the property and concerns of the county pursuant to K.S.A. 19-101; fourth.  K.S.A. 68-521 and K.S.A. 68-1413 authorize expedited contract approval procedures for roads and bridges, respectively, when damage has been sustained as a result of flood waters.  Pursuant to Sedgwick County’s purchasing charter resolution, the Purchasing Director has determined that this is an emergency, and has therefore waived the competitive bidding requirements.  Approval is by simple majority vote.
