A Resolution Temporarily Suspending A Cereal Malt Beverage License - Sedgwick County Zoological Society, Inc.

Recommended Action: Approve the resolution and authorize the Chairman to sign.
The Sedgwick County Zoological Society Inc. (Zoo) currently holds a cereal malt beverage license issued by the Board of County Commissioners (BOCC) which expires on December 31, 2016. The Zoo is requesting and does hereby consent to and support the voluntary suspension of its license for one (1) day, specifically Friday, November 18, 2016, to facilitate the "Wild Wines" event at the Sedgwick County Zoo on that day.

Legal Considerations: K.S.A. 2015 Supp. 41-2704(g) and K.S.A. 2015 Supp. 41-2708(a)(5) prohibit alcoholic liquor from being on a premises licensed for cereal malt beverage sales. K.S.A. 2015 Supp. 41-2703 places responsibility for licensing the retail sale of cereal malt beverages upon counties. In order to comply with statutes, limited suspension of the cereal malt beverage license is necessary and the county has the power to do so under K.S.A. 2015 Supp. 41-2703. A simple majority vote is required.
