Recommended Action: Adopt the Resolution.

 

Specifically, 93rd Street North between Meridian and Seneca (596-25).  District 4.

Legal Considerations: The BoCC is authorized to perform such duties as required by law concerning roads under K.S.A. 19-212 Ninth. K.S.A. 68-506 provides that in counties such as Sedgwick County not operating under the county road unit system, the BoCC with the approval of the County Engineer is to classify and designate roads and highways in the county. The BoCC and County Engineer can reclassify a road when deemed appropriate based on engineering analysis or changing traffic needs. Under K.S.A. 68-526, if a road is classified and designated as a township road, the township board has the general charge and supervision of the road, and is responsible for maintenance. Approval requires only a simple majority, and the resolution is effective upon adoption. The resolution is not subject to protest.
