Approval of four (4) agreements between the Union Pacific Railroad Company, Sedgwick County and the Secretary of Transportation of the State of Kansas regarding the construction and/or maintenance of highway crossing signals at various locations.

Recommended Action: Approve the agreements and authorize the Chairman to sign.

 

The agreements are for the following locations:

The tracks at 117th Street North, east of Greenwich Road $228,732.00

The tracks at west 3rd Street in Furley (no existing crossing signals) $253,586.00

The tracks at 77th Street North, east of Woodlawn $237,350.00

The tracks at 95th Street South, east of Meridian $238,707.00

Financial Considerations: Total Project Estimate: $958,375.00 100% Federally Funded. Per the agreements, Union Pacific Railway Company will be reimbursed for the full cost of crossing improvements by the State of Kansas using Federal funds.  Costs incurred by the County from installing the warning signs will be operational costs funded out of the existing operational budget.

 

Legal Considerations: 23 U.S.C. §130 provides for federal funding of these improvements. The BoCC is authorized to make all contracts in relation to the property and concerns of the County under K.S.A. 19-101 fourth; and to perform such duties as required by law concerning roads under K.S.A. 19-212 Ninth. This contract is similar in terms and conditions to prior contracts approved by the BoCC for this purpose.  Approval is by simple majority vote.
