Recommended Action: Approve the resolution and authorize the Chairman to sign.
The Sedgwick County Zoological Society Inc.(Zoo) currently holds a cereal malt beverage license issued by the Board of County Commissioners (BOCC) which expires on December 31, 2016. The Zoo is requesting and does hereby consent to and support the voluntary suspension of its license for three (3) days, specifically Friday, September 9, Saturday, September 10, and Sunday, September 11, 2016, to facilitate the "Zoobilee" event at the Sedgwick County Zoo during those days.

Legal Considerations: K.S.A. 2015 Supp. 41-2704(g) and K.S.A. 2015 Supp. 41-2708(a)(5) prohibit alcoholic liquor from being on a premises licensed for cereal malt beverage sales. K.S.A. 2015 Supp. 41-2703 places responsibility for licensing the retail sale of cereal malt beverages upon counties. In order to comply with statutes, limited suspension of the cereal malt beverage license is necessary and the county has the power to do so under K.S.A. 2015 Supp. 41-2703. A simple majority vote is required.
