Supplemental Agreement No. 3 to the KDOT Agreement for Construction of the I-235 and US-54 Interchange (R-334). District 2.

Recommended Action: Approve the supplemental agreement and authorize the Chairman to sign.
In 2012, Sedgwick County, the City of Wichita, and the Kansas Department of Transportation (KDOT) entered into an agreement to finance and construct interchange improvements at I-235 and US-54. Sedgwick County is the local financial partner and will pay $11.6M to fund the project over a three year period.
As planned, the project would remove the railroad bridge over the Wichita - Valley Center Flood Control Project. Prairie Travelers, Inc., is working to develop a trail system on the rail banked right of way running west out of Wichita and has been in discussion with the City of Wichita about keeping the bridge for trail use. Supplemental Agreement No. 3 proposes to retain the bridge and places responsibility for future maintenance and removal as required on the City of Wichita.
Alternatives: Do not approve the supplemental agreement.
Financial Considerations: Supplemental Agreement No. 3 does not add any additional costs or burdens on Sedgwick County.
Legal Considerations: The BoCC is authorized to make all contracts in relation to the property and concerns of the county under K.S.A. 19-101 fourth; and to perform such duties as required by law concerning roads under K.S.A. 19-212 ninth. Under K.S.A. 12-2908, the BoCC may enter into contracts with other cities or townships to perform any governmental service, activity or undertaking that each entity is authorized to perform.
