Setting a Public Hearing for the Proposed Adoption of the 2015 International Fuel and Gas Code .

Recommended Action: Set the public hearing and direct the County Clerk to publish the Notice of Public Hearing in the official county newspaper.

 

The Board of County Commissioners has already set a public hearing for its regular meeting on October 5, 2016, for the adoption of the 2015 Uniform Plumbing Code (“UPC”), the 2015 International Plumbing Code (“IPC”), and the 2015 International Residential Code (“IRC”), as it applies to plumbing.  This agenda item proposes to set a public hearing during that same October 5, 2016 meeting for the adoption of the 2015 International Fuel and Gas Code (“IFGC”).

 

The 2015 IFGC is published by the International Code Council.  The adoption and incorporation of the 2015 IFGC would be proposed to be contained within the resolution that proposes the adoption and incorporation of the 2015 versions of the UPC, IPC, and IRC.  The proposed effective date of said resolution would be November 1, 2016.  If passed, it would be effective within the unincorporated area of Sedgwick County and in those cities that contract with the County.

 

Recommended Action: Set the public hearing and direct the County Clerk to publish the Notice of Public Hearing in the official county newspaper.

Legal Considerations:  Pursuant to K.S.A. 12-3303, for any codes that are adopted by reference in a resolution, a public hearing is required to be scheduled and a notice regarding that public hearing is required to be published in the official county newspaper.  A simple majority vote is required to set this public hearing.
