In 2006, the Board of County Commissioners (BOCC) passed a resolution (Res. No. 74-06; “Title Transfer Code”) that required wells and on-site wastewater systems to be inspected whenever title to the underlying real property within the unincorporated area of Sedgwick County was transferred from one party to another party. The stated purpose for the enactment of the Title Transfer Code was to protect public health and prevent the contamination and pollution of water within Sedgwick County.
There is no federal or state law that requires the Title Transfer Code permitting and inspections to be completed by Sedgwick County. If the Title Transfer Code were repealed, these inspections of on-site wastewater systems, water wells, and water samples would no longer be required. Also, staff of the Metropolitan Area Building and Construction Department (MABCD) would no longer be involved in permitting and inspecting these items. However, private sector vendors could offer this inspection service in a similar fashion to prospective property owners who may seek to have a home inspection completed before they finalize the purchase.
Alternatives: The BOCC could decide to not approve the resolution.
