Agreement between Sedgwick County and the Oaklawn Improvement District for Controlled Access to Certain Roadways.

Recommended Action: Approve the agreement and authorize the Chairman to sign.
For the purpose of sponsoring the Oaklawn Fall Festival on September 17, 2016 from 10:00 a.m. to 11:00 a.m., the County is granting the Oaklawn Improvement District the authority to have controlled access to the certain roadways (see map, Exhibit A) which are controlled or maintained by the County. For purposes of this Agreement, 'controlled access' is defined as the non-exclusive use of public roadways to the extent that the use does not conflict with public safety as determined by the Sedgwick County Sheriff. The Oaklawn Improvement District agrees to coordinate with the Sheriff's Office with regard to traffic control upon the County roadways used for such purpose.

Legal Considerations: K.S.A. 19-212 vests the Board of County Commissioners with broad powers in conducting the business of the County at a meeting. The County’s general police powers allow protection of the public health, safety, and general welfare of the public. This agreement is similar to prior controlled access agreements. A Certificate of Insurance, approved by the Office of the County Counselor, is required and has been provided pursuant to Section 4 of the agreement.
