ISLAND ANNEXATION REQUEST FOR CITY OF VALLEY CENTER PURSUANT TO CITY OF VALLEY CENTER RESOLUTION NO. 654-16, AS AMENDED BY RESOLUTION NO. 657-16.

RECOMMENDED ACTION:  Find that the proposed annexation will not hinder or prevent the proper growth and development of the area or that of any other incorporated city located in Sedgwick County; and therefor approve the resolution.

Body

The City of Valley Center ("City") adopted Resolution No. 654-16 pursuant to K.S.A. 12-520c that requests the Sedgwick County Board of County Commissioners make a finding that the proposed annexation will not hinder or prevent the proper growth and development of the area or that of any other incorporated city located in Sedgwick County.  Island annexations are done at the request or with the consent of the landowners whose land is being annexed.  In this instance, Unified School District No. 262 (Valley Center School District) passed a motion and resolution on June 13, 2016 requesting the City to complete the island annexation.  The land proposed to be annexed includes the recently constructed Valley Center High School.  The area requested for annexation is generally located on the northeast corner of the intersection of 93rd Street North and Meridian.

 

MAPD staff has reviewed the proposed annexation and recommends approving the annexation and finding that the annexation will not hinder or prevent the proper growth and development of the area or of any other city, as long as the City also island annexes, concurrent with this island annexation request, the west half of the Meridian Street right-of-way and the south half of the 93rd Street North right-of-way.  The MAPD noted that annexing the entirety of these streets, rather than just one-half, would "ensure complete effectiveness and efficiency in the delivery of future road maintenance/repair services and traffic control services adjacent to the proposed island annexation parcel..."  Sedgwick County Public Works also noted the street maintenance and law enforcement problems that would exist if only one-half of those streets were to be annexed.

 

On August 16, 2016, the City's City Council adopted a new resolution (Resolution No. 657-16) to amend its annexation request to include the entirety of the road rights-of-way on the aforementioned portions of Meridian Street and 93rd Street North.

 

Alternatives:

 

A. Make a finding that the proposed annexation will not hinder or prevent the proper growth and development of the area or that of any other incorporated city located in Sedgwick County; and therefore approve annexation request.

 

B. Make a finding that the proposed annexation will either hinder or prevent the proper growth and development of the area; or that it would hinder or prevent the proper growth and development of any other city; or both, and therefore deny annexation request.

 

Financial Considerations: None.

 

Legal Considerations: County Resolution No. 109-2012 provides that following a finding by the Board of County Commissioners, a resolution is prepared, submitted to the Board for approval, and then after approval, the resolution is sent to the City.  Approval requires a 2/3 vote of the members of the Board of County Commissioners (4 votes).
