A Charter Resolution Repealing Charter Resolution No. 26 Pertaining to the Kansas Coliseum.

Recommended Action: Approve the Resolution.
On August 15, 1979, the County adopted Charter Resolution 26 (Res. 203-1979) which exempted the County from the provisions of K.S.A. 19-2693, a non-uniform statute. Charter Resolution 26 provides substitute and additional provisions on the same subjects provided in K.S.A. 19-2693, pertaining to reports, documentation and controls relating to coliseum funds, approval of contracts and bonds. The County sold the Kansas Coliseum property in 2012; therefore, the provisions of Charter Resolution 26 are no longer applicable. Repealing the resolution will clarify that the resolution is not applicable.
Alternatives: Do not approve the Resolution.

Legal Considerations: This action requires a 2/3 vote for approval. K.S.A. provides that a charter resolution may be repealed by a charter resolution upon a 2/3 vote of all board members.
