This PARTIAL DEDICATION OF ABUTTER’S ACCESS RIGHTS is required to finalize the vacation of platted access control requested by Sedgwick County for property the County purchased near Webb Rd and 35th St N.
In January 2016 the Board of County Commissioners authorized the purchase of land located on Webb Rd near 35th St N for the purpose of constructing a future EMS Post, shown as Parcel B in the attached recorded lot split. In order to have full use of the parcel, Sedgwick County initiated proceedings to vacate platted access control to Parcel B along Webb Rd, which has been approved by the MAPC. The attached PARTIAL DEDICATION OF ABUTTER’S ACCESS RIGHTS document is required as the final step before City Council approval of the access control vacation and allows Sedgwick County one opening on the east property line on to Webb Rd.
Alternatives: The BOCC could choose not to approve the agreement, in which case another method for vacating access control to Parcel B would need to be found.
Financial Considerations: None
Legal Considerations: Under KSA 19-101 fourth the Board is authorized to make all contracts and do all other acts in relation to county property necessary for the exercise of its corporate and administrative powers. Approval is by simple majority vote.
Policy Considerations: This agreement follows established policies and procedures.
