Recommended Action: Approve the agreement and authorize the Chairman to sign.
The County has applied for and been awarded federal funds through WAMPO to construct the Aviation Pathway from Derby to Wichita. The federal funds require a 20% local match. The purpose of this agreement is to split the local match equally between the County and the City of Derby. The County and KDOT have an agreement in place to provide the 20% match to KDOT. The project is split into two phases. The total local cost is expected to be $599,000. When split equally, the County and the City of Derby will each pay an estimated $299,500.
Alternatives:
Financial Considerations: The County currently has funds in place to pay 100% of the local match for the first phase of construction. This agreement will provide funding from the City of Derby for one half of the actual match paid to KDOT. The estimated contribution from the City of Derby is $299,500.
Legal Considerations: The Board of County Commissioners is authorized to make all contracts in relation to the property and concerns of the county under K.S.A. 19-101 fourth. Under K.S.A. 12-2908, the Board of County Commissioners may enter into contracts with other cities or townships to perform any governmental service, activity or undertaking that each entity is authorized to perform.
