Agreement with the City of Valley Center for Funding and Construction of 93rd St. North between Meridian and Broadway.  District 4.

Recommended Action: Approve the agreement and authorize the Chairman to sign.

 

Public Works is authorized in the 2016 CIP to construct new pavement on 93rd St. North from Meridian to Seneca.  The project is adjacent to the City of Valley Center and the City has asked that the County extend the project from Seneca to Broadway.  Both the City and County expect to benefit from economies of scale.  Bids were received on April 26, 2016 and the City and County have been working to finalize a project agreement.  The agreement was approved by the Valley Center City Council on June 7, 2016.

 

Under the agreement, Valley Center will be responsible for all costs of construction east of Seneca.  The City share is $770,000.  The County is responsible for all costs of construction west of Seneca.

 

Alternatives: 

 

Financial Considerations:  The CIP includes $600,000 for construction of the portion west of Seneca.  As bid, the County share is expected to be $627,760.38.  A CIP Amendment is needed to increase the County funding by $65,426 ($27,760.38 for construction and $37,665.62 for a construction contingency).  The agreement provides for $770,000 in funding from Valley Center and the proposed CIP Amendment will include that funding into the project budget.

 

Legal Considerations:  The BoCC is authorized to make all contracts in relation to the property and concerns of the county under K.S.A. 19-101 fourth; and to perform such duties as required by law concerning roads under K.S.A.  19-212 ninth.  Under K.S.A. 12-2908, the BoCC may enter into contracts with other cities or townships to perform any governmental service, activity or undertaking that each entity is authorized to perform.
