RECOMMENDED ACTION: Discuss positions of the parties as presented in the public hearing of May 11, 2016, update status of negotiations after May 11, 2016, and adopt proposed Memorandum of Agreement as presented.

 

Body

Sedgwick County Fire District No. 1 and its local bargaining unit, I.A.F.F. Local No. 2612 have been engaged in negotiations for a 2016-2017 Memorandum of Agreement, pursuant to the Public Employee Employer Relations Act (K.S.A. 75-4321 et seq.) since April 2015.  Since negotiations began, the parties have participated both in a fact-finding hearing as well as a public hearing and have each offered recommendations and explanations as to their individual positions.  To date, the parties have failed to reach an agreement.

Alternatives:  Direct the parties to continue their negotiations.

Financial Considerations: The Memorandum of Agreement will, among other things, determine the compensation structure and other conditions of employment for Bargaining Unit employees. Accordingly, the Memorandum of Agreement will have a significant impact on Fire District No. 1’s budget in both the Agreement years, as well as all future years.

Legal Considerations:  Pursuant to K.S.A. 75-4332(f), if the parties remain at impasse after negotiations, fact-finding and a public hearing, the governing body is directed to take such action as it deems to be in the public interest, including the interest of the public employees involved. This includes, although is not limited to imposing a unilateral Memorandum of Agreement.
