Title

Agreement Between the Board of County Commissioners and the Kansas Humane Society of Wichita, Inc.

Body

Recommended Action: Approve the Agreement and authorize the Chairman to sign.

This is a renewal of the existing five year agreement with the Kansas Humane Society of Wichita, Inc. allowing the annual Woofstock event to be held at Sedgwick County Park.  The event will be held on dates mutually agreed upon and must be scheduled with the Park Superintendent no later than April 1 each year.

The term of this agreement is for five (5) years beginning on the date of execution of this agreement.

Financial Considerations:  TBD - Because Sedgwick County will not allow any third party to use any shelter during the Woofstock event, the Kansas Humane Society of Wichita, Inc. agrees to pay the shelter fees set out in the Sedgwick County Code, in addition to the Large Event Fee required by the Sedgwick County Code for the following shelters:  Horseshoe, Cottonwood, Shelters 1,2, 4, and 5.  The total fee will be $750.

Legal Considerations:  The Park Superintendent may grant the Humane Society of Wichita, Inc. controlled access to a road or roads within Sedgwick County Park.  "Controlled access" is defined as the non-exclusive use of public roadways to the extent that the use does not conflict with public safety as determined by the Sedgwick County Sheriff.  The Humane Society of Wichita, Inc. agrees to coordinate with the Sheriff's Office with regard to traffic control upon the County road(s).

A Certificate of Insurance, approved by the Office of the County Counselor, is required and will be provided pursuant to Section 5 of the agreement.

Policy Considerations: N/A
