RESOLUTION ADOPTING A POLICY FOR SIGNS IN THE PUBLIC RIGHT OF WAY CONSISTENT WITH K.S.A. 25-2711.

RECOMMENDED ACTION: Approve the resolution.

 

Body

State law states that the County Engineer has a duty to maintain county roads, ditches and rights of way for public safety.  In 2015 a new statute was passed that allows the placement of political campaign signs in the pubic road right of way during a period beginning 45 days before an election and ending 2 days after the election.  That statute also allows the regulation of sign placement in order to address public safety.  The purpose of the policy is to strike a balance between public safety and free speech along county maintained roads.

 

The resolution establishes policy for the size, weight and height of signs as well acceptable locations for the safe placement of signs during the election period.  It provides direction to Public Works and the Metropolitan Area Building and Construction Department for handling and disposition of signs located in the county maintenance right of way.

 

Alternatives:  Take action as the board deems appropriate.
