Agreement with Eagles Realm, LLC for the Great Plains Renaissance Festival and the Wichita Highlands Games and Festival.

Recommended Action: Approve the agreement and authorize the Chairman to sign.
Sedgwick County will allow Eagles Realm, LLC exclusive use of portions of the Sedgwick County Park for the their annual Great Plains Renaissance Festival and the Wichita Highlands Games and Festival. The term of this agreement is for five (5) years, commencing on April 22, 2016, and ending April 21, 2020. The annual festival shall have the exclusive use of the Licensed Premises (which generally refers to the area in Sedgwick County Park set forth in Exhibit A and specifically excludes any use or control whatsoever by Eagles Realm, LLC of the Bait Shop) for up to four (4) multi-day events per calendar year at dates and times to be agreed upon by the Sedgwick County Park Superintendent and Eagles Realm, LLC. Permitted activities may include, but are not limited to, the following:
Sword theatrical shows, heavy armor combat shows, Amira Belly Dancer shows, various musical performances, and vendors selling
goods and performing demonstrations.
Eagles Realm, LLC will notify and seek written use approval from the Sedgwick County Park Superintendent at least sixty (60) days prior to a scheduled event. They will have exclusive use of the Licensed Premises beginning at 7:00 am on the day prior to the first day of a scheduled event and ending at 10:00 pm on the day after the scheduled event concludes.
Event dates for 2016 are as follows: April 22-24, 2016, and September 23-25, 2016.
Event dates for 2017, 2018, 2019 and 2020 will be as agreed upon in writing between the Sedgwick County Park Superintendent and Eagles Realm, LLC.
Admission prices for all events will be $6.00 in advance and $8.00 at the gate. Eagles Realm, LLC will seek approval from the Sedgwick County Park Superintendent prior to changing any admission prices.
Financial Considerations: Eagles Realm, LLC agrees to pay Sedgwick County as follows for each event:
Large Event Fee of $250.00 per day
Shelter Fee as provided in Sedgwick County Code Section 20-109
Fifteen percent (15%) of the gross receipts from the sale of all cereal malt beverages
Fifteen percent (15%) of the gross receipts from the sale of admission tickets.\
Fifteen percent (15%) of the gross receipts from the sale of all food and beverage novelties as are approved in advance by Sedgwick County
Legal Considerations: A certificate of insurance, approved by the County Counselor, is required and will be provided pursuant to Section 7 of the agreement.
