A RESOLUTION ADOPTING THE INTERNATIONAL BUILDING CODE, PUBLISHED BY THE INTERNATIONAL CODE COUNCIL, INC., 2012 EDITION.

Recommend Action: Approve the resolution and authorize the Chairman to sign.

 

Body

Within Article 2 of the Unified Building and Trade Code (UBTC), the International Building Code, 2006 Edition, along with local amendments was adopted by the Board of County Commissioners of Sedgwick County and the City of Wichita City Council as the commercial code within the jurisdiction of the MABCD. Subsequently, the publisher of the International Building Code released its 2009 and 2012 editions of the code. MABCD staff and members of the MABCD's Board of Building Code Standards and Appeals (Building Board) reviewed the International Building Code, 2012 Edition, and extensively discussed it during meetings of the Building Board. The Building Board then voted and unanimously approved the adoption of the International Building Code, 2012 Edition, along with the changes to the UBTC that are included within the resolution that is before the Board of County Commissioners.

 

Alternatives:  The Board of County Commissioners could vote to not approve the resolution.

 

Financial Considerations:  N/A

 

Legal Considerations: Pursuant to K.S.A. 12-3303, the Board of County Commissioners may adopt a code by reference within a resolution.  The public hearing required by that same statute for such a code adoption was held on February 17, 2016.  Approval is by simple majority vote.

 

Notice of public hearing and the required public hearing for adoption of this resolution have both occurred, consistent with K.S.A. 12-3303.  Pursuant to K.S.A. 19-101 et seq., the County may adopt this resolution.  A simple majority vote is required.
